General Information
These General Conditions of Sale govern the purchase of products offered by Lola S.r.l., with registered office in Via Fatebenefratelli 15, 20121 Milan, P. IVA 05201700266 ("Chiara Costacurta", "we" or "our"), through the website www.chiaracostacurta.com (the "Website").
By placing an order through the Website, you declare that you have read and accepted these General Conditions of Sale, as well as the Website Terms of Use and the Privacy Policy, which are fully incorporated herein by reference.
These General Conditions contain important information regarding product purchase methods, payments, shipments, returns, and the rights and obligations of the parties. We therefore invite you to read them carefully before proceeding with any purchase.
If you do not intend to accept these General Conditions, the Website Terms of Use, or the Privacy Policy, we invite you not to use the Website to place orders or make purchases.
Products
The products offered on the Website are described and presented with the utmost accuracy possible. However, images, photographs, and graphic representations are for illustrative purposes only and may differ slightly from the final product.
The characteristics of the materials used, including precious stones and natural diamonds, make each creation unique. Slight variations in color, natural inclusions, nuances, or other characteristics inherent to stones and precious metals do not constitute defects, but rather distinctive elements of each jewel's uniqueness.
Some products or variations may be available exclusively by order. In such cases, any production and delivery times will be indicated on the relevant product page or communicated before order confirmation.
Chiara Costacurta reserves the right to modify, update, or discontinue the production of any product at any time and without prior notice.
Chiara Costacurta's ordinary offering primarily consists of selected natural diamonds and natural precious stones. Upon customer request, it is possible to develop customized projects that involve the use of lab-grown diamonds or stones.
Such creations are evaluated and quoted on a case-by-case basis and are not usually included in the permanent collections or the brand's ordinary communication.
Orders
To place an order on the Website, you must be of legal age and have the legal capacity to act.
Placing an order through the Website constitutes an offer to purchase the selected products. Once the order is received, Chiara Costacurta will send an automatic receipt confirmation to the email address provided by the customer. This communication only confirms the successful receipt of the order and does not constitute acceptance of it.
All orders are subject to verification and acceptance by Chiara Costacurta. We reserve the right to refuse or cancel an order, even after sending the receipt confirmation, if circumstances prevent its proper fulfillment.
At the time of purchase, it will be possible to choose between shipping to the indicated address or collection from our atelier in Milan, where available.
For orders with atelier collection, the customer will receive a notification as soon as the product is available. Collection can be made in person or by a delegated person, by prior arrangement with our team.
Upon delivery or collection, the customer is required to check the integrity of the packaging and the conformity of the product received. Any anomalies must be promptly reported to our customer service.
Prices and payments
All prices indicated on the Website are expressed in Euros (€) and include VAT, where applicable.
Shipping costs, where applicable, will be indicated separately during the purchase process and before order confirmation.
Payment can be made using the methods available on the Website at the time of purchase.
Chiara Costacurta reserves the right to modify the prices of products on the Website at any time. Although the brand does not constantly adjust its price lists to fluctuations in the precious metals market, it reserves the right to update prices in consideration of significant variations in the cost of raw materials, production processes, or other factors affecting the final value of the product. Any changes will not affect already confirmed orders.
For some made-to-order products or projects developed through the Personalized Atelier service, a deposit may be required. The relevant economic conditions, including any payment deadlines, will be communicated and agreed upon with the customer before production begins.
For personalized projects involving the use of selected diamonds or precious stones upon request, the value of the stone will be determined through a dedicated quotation carried out with our specialized suppliers. This quotation will depend on the characteristics of the requested stone and market conditions at the time of selection. The final price will always be shared and approved by the customer before production begins.
Shipments
Chiara Costacurta ships worldwide via DHL courier.
All shipments are covered by insurance until delivery.
Shipping is free for all orders destined for Italy. For international shipments, delivery costs are calculated based on the destination country and indicated during the purchase process.
Delivery times vary depending on product availability and shipping destination. For available products, shipping will be made within the times indicated at the time of purchase.
For made-to-order products, delivery times also include the time required for the jewel's production. Estimated times will be indicated on the product page and during the purchase process; any particular needs can also be agreed upon directly with our team.
Once handed over to the courier, the customer will receive a communication containing the necessary information to track the shipment.
Products are delivered to the address indicated by the customer at the time of order. It is the customer's responsibility to verify the accuracy of the data provided and to check the integrity of the packaging upon delivery.
For shipments to non-EU countries, any customs duties, local taxes, or other import charges required by the legislation of the destination country will be borne by the recipient.
Made-to-order products
Some products and variations on the Website are available exclusively by order.
Made-to-order products are developed and produced after order confirmation, according to the specifications selected by the customer. For this reason, their production and delivery times may differ from immediately available products.
Indicative production times are reported on the product page and during the purchase process. Any updates or particular needs can be agreed upon directly with our team.
Made-to-order products may show slight differences compared to the images published on the Website, due to the natural characteristics of the materials used or the specific requests of the customer.
If, for reasons beyond Chiara Costacurta's control, it is not possible to create the ordered product according to the requested specifications, the customer will be promptly informed and can choose between an alternative solution agreed upon with our team or a refund of any sums paid.
Personalized Atelier
Chiara Costacurta offers a Personalized Atelier service dedicated to customers who wish to develop a custom-made creation or personalize an existing jewel.
The project can originate from a collection model, a stone already owned by the customer, or an idea developed together with our team. Each request is evaluated individually and accompanied through a dedicated consultation process.
The service can be carried out at our Milan atelier or remotely, through video call appointments arranged with the customer.
To start the project, a deposit may be requested, generally equal to 30% or 50% of the estimated value of the creation, as agreed with the customer. Production will begin only after confirmation of the project and payment of any requested deposit.
The entire creative and productive development process has a variable and non-standardized duration, depending on the complexity of the project, the availability of materials, the selection of stones, and any revisions agreed upon with the customer. Estimated times will be communicated on a case-by-case basis before production begins.
Any diamonds or precious stones specially selected for the customer will be subject to a dedicated quotation and must be approved before production begins.
The customer's confirmation of renderings, design drawings, stone selection, or other creation specifications constitutes definitive approval of the project characteristics and authorizes the start of production, with the consequent exclusion of subsequent disputes relating to the approved elements.
Projects carried out through the Personalized Atelier service are developed according to the customer's specific requests and, therefore, cannot be returned or refunded, except as provided by applicable law or in the case of conformity defects.
Returns and right of withdrawal
In accordance with current legislation, the customer has the right to withdraw from the purchase within fourteen (14) days from the date of receipt of the product, without needing to provide any reason.
To exercise the right of withdrawal, the customer must send a communication to the email address indicated on the Website within the aforementioned deadline. Once the request has been received and verified, our team will provide instructions for returning the product.
Products must be returned intact, free from signs of use, wear, or alteration, complete with original packaging and any certificates, documentation, or accessories received upon delivery.
For orders delivered in Italy, the return process has a fixed cost of €8.00, which will be deducted from the refunded amount.
For orders delivered outside of Italy, return shipping costs are borne by the customer. Once the return request has been approved, our team will provide the customer with the necessary instructions for returning the product.
Subject to confirmation from our team, returns can also be made at our atelier in Milan.
Once the returned product has been received and verified, Chiara Costacurta will refund the price of the purchased product using the same payment method used for the purchase. For international orders, any costs incurred by the customer for returning the product will not be refunded.
Pursuant to Art. 59 of Legislative Decree 206/2005 (Consumer Code), the right of withdrawal does not apply to products made to measure, personalized at the customer's request, or developed through the Personalized Atelier service, including projects that involve the dedicated selection of diamonds or precious stones.
Warranty
All Chiara Costacurta products are covered by the legal guarantee of conformity provided for by current legislation.
The warranty covers any defects of conformity existing at the time of delivery of the product and appearing within the terms provided by law.
The warranty does not cover damages resulting from improper use, accidents, bumps, falls, modifications or repairs carried out by third parties, normal wear and tear of the product, failure to observe care and maintenance instructions, or deterioration due to daily use.
The natural characteristics of diamonds, precious stones and precious metals, including any inclusions, chromatic variations or other intrinsic peculiarities of the materials, do not constitute defects and are therefore not covered by the warranty.
Should the customer encounter a problem with their jewel, they are invited to promptly contact our team, who will evaluate the specific case and provide indications on possible assistance, repair or maintenance solutions.
This warranty does not affect the rights granted to the consumer by applicable law.
Jewellery care and maintenance
Chiara Costacurta jewellery is made with selected precious materials and deserves special care in its preservation and daily use.
To preserve its beauty over time, we recommend storing each piece of jewellery separately, avoiding contact with other objects that could cause scratches or damage.
For ordinary cleaning, lukewarm water, mild soap, and a soft cloth are generally sufficient. It is recommended to avoid contact with corrosive or aggressive substances, such as bleach, acetone, alcohol, and chemical detergents not specifically intended for cleaning jewellery.
Particular attention is recommended when using ultrasonic cleaning devices. Although they may be suitable for some diamond jewellery, their use is generally not recommended for jewellery featuring precious or ornamental stones other than diamonds. The hardness of a stone does not, in fact, provide sufficient guarantee of its resistance to the vibrations generated by ultrasound, which could compromise its integrity or setting.
Should you wish to receive specific instructions on the maintenance of a particular creation or request an inspection, cleaning, or assistance, our team will be happy to provide dedicated support.
Intellectual property
All content on the Website, including texts, photographs, images, renderings, drawings, logos, trademarks, graphic elements and editorial content, are the property of Lola S.r.l. or their respective owners and are protected by applicable intellectual property law.
Any reproduction, distribution, modification, publication or use, in whole or in part, of the contents of the Website without the prior written authorization of Lola S.r.l. is prohibited.
Applicable law and competent court
These General Conditions are governed by Italian law.
For any dispute relating to the interpretation, validity, execution or effectiveness of these General Conditions, the court provided for by the applicable consumer protection legislation will have jurisdiction.
